Agency agreement (AGAM)
- General Provisions
- Questra World delegates the AGENT to carry out advertising, consulting and informative activities, with the aim of promoting the activities of Questra World and increasing the sales of its products.
- The AGENT services customers and partners of Questra World, which have established as a result of his advertising, consulting and informative activities, for which he receives remuneration in the form of a fee.
- The AGENT may create and manage structures in exchange for a fee according to the career ladder - Annex 1, which is an integral part of a formal agreement.
- The AGENT shall not accept payments from a client, unless he is authorized to do that by Questra World. All payments are made via bank transfers and electronic payment systems which are partners of Questra World.
- Questra World automatically handles all the data on its customers. Questra World can provide information concerning the AGENT and his customers to third parties only in cases prescribed by law.
- The AGENT shall preserve confidentiality of all information relating to clients and partners of Questra World, both in the period of this contract, and after its termination.
- The AGENT is not entitled to give binding promises and statements on behalf of Questra World, as well as to enter into other transactions with customers of Questra World, without its precise written consent.
- The Obligations of the Customer Service AGENT
- The AGENT acquaints the customers with Questra World activity and the risks related to it, resulting from the fluctuations in the financial markets, within the individual needs of the client.
- The AGENT shall not use aggressive methods of distribution, as well as provide the customers with false and inaccurate information regarding the Questra World.
- The AGENT immediately transmits to Questra World all important customers’ comments relating to the business of Questra World.
- The AGENT must let the customer make his decision himself.
- The AGENT shall not give promises of profit.
- The AGENT also must:
- Carry out his activities independently at his own expense and risk, covering all the necessary expenses.
- Systematically work on the selection, teaching and training new consultants. Organize theirtraining in the form of specialized thematic discussions, lectures, seminars, etc. Promote their internship under the supervision of more experienced professionals and consultants; provide them with ongoing support and assistance in the development of self-employment.
- Organize work of the direct subordinate agents according to their qualification requirements.
- In the event of any unforeseen circumstances, negatively affecting the activity or reputation of Questra World, immediately inform about the facts the direct superior agent and the administration of Questra World in writing.
- Participate in all mandatory activities organized by Questra World, especially those related to advanced training of the AGENT.
- Train on specialized and qualifying seminars organized by Questra World when moving upward in the career.
- Not apply to the administration of Questra World on the transitions from one directorate to another or on the matters of replacement of the direct superior agent to another.
- Independently determine the location, time and volume of his activity specified in the contract.
- If necessary make proposals to improve the effectiveness of Questra World activity in writing through the head of his structure.
- Remuneration and Career Growth
- Remuneration of the AGENT depends on his agency level which he holds in the career ladder of the company. The basis for the calculation of the remuneration is a percentage of profitability and the sales volume of the agent and his structure.
- The remuneration of the AGENT is equal to the multiplying of sales volume of products "Investor`s Portfolio" by his rate of return, according to his agency level. Accrual of remuneration is carried out automatically after the sales of products are made. In calculation of the remuneration are taken into account sales volume made both by the AGENT personally, and by his structure.
- Through a personal account each AGENT receives information on all products of Questra World, sold as a result of his promotional and advisory activities, as well as his structure.
- The AGENT may express reservations to the Questra World concerning the provided data, within 15 calendar days.
- The relationship between the AGENT and the employees, under his supervision, are determined in accordance with the corporate ladder, approved by Questra World - Annex 1.
- If someone from the staff members of the AGENT`s structure reaches the same level as the AGENT himself according to the career ladder - Annex 1, the AGENT is not entitled to receive remuneration for the employee from the moment of their leveling.
- When leveling according to the career ladder - Annex 1, the results of the advanced employee are included into the scope of the related AGENT.
- If the downline employee reaches the level higher than the level of his AGENT, the service relationship should not be completely finished, if only these levels are aligned again for the next 3 months,.
- Compensation to each AGENT is performed within no later than 3-7 working days after filling an application for compensation.
- All AGENT`s remunerations are calculated in accordance with the corporate ladder - Annex 1.
- When introducing new products, the AGENT of Questra World will be informed of the rates in the career ladder.
- The remunerations, which the AGENT receives from his employees, subordinate managers, make up the difference between the margin of the AGENT according to his agency level and the margin of his employee, the downline manager - Annex 1.
- If the downline agent terminates the contractual relationship with Questra World, the higher relevant AGENT takes the service of the created structure. The remunerations are accordingly reviewed.
- Upon reaching the 4th level of the career ladder of Questra World, the AGENT may at his own expense open an office of Questra World, after obtaining its written consent.
- Provisions for the AGENTS who are not citizens of the European Union:
- For the AGENTS of Questra World, who are not citizens of the European Union, but live and work on Questra World outside the EU, Questra World assumes the following responsibilities:
- For the AGENT who has reached the 3rd level of the career of Questra World, to provide full legal and marketing assistance, with the desire on his part, to buy property in the territory of the European Union or to stay temporary in the country.
- For the AGENT who has reached the 4th level, with the desire on his part, to assist him in obtaining a permit for an extended or permanent residence in the territory of the European Union.
- Advertising
- Questra World permits to conduct marketing activities in order to promote the company in the press, on radio, on television and in the Internet without any restrictions.
- Representation of Questra World:
- With the written permission of Questra World the AGENTS have the right to organize regional and inter-regional structural representations.
- Questra World assumes no material and legal responsibility for the work of regional inter-regional representations and does not participate in the work with the local administrative authorities.
- Bonus Program
- The AGENT of Questra World is entitled to get additional monetary bonuses from Questra World under the bonus program - Annex 2. According to the terms of the bonus program the agent must personally or together with his structure make sales volumes necessary for meeting the conditions of the bonus program. Bonus program of Questra World is not attached to the level of the agent and is entirely dependent on the sales volume of the agent and his structure. One of your agents can not be accounted more than 50% of the required volume of sales to get bonuses.
- The AGENT of Questra World after achieving the sales volume of 25 000 euro, both personally and together with his structure gets monetary remuneration of 1000 QP.
- The AGENT of Questra World after achieving the sales volume of 50 000 euro, both personally and together with his structure gets monetary remuneration of 2000 QP.
- The AGENT of Questra World after achieving the sales volume of 100 000 euro, both personally and together with his structure gets monetary remuneration of 5 000 QP.
- The AGENT of Questra World after achieving the sales volume of 500 000 euro, both personally and together with his structure gets monetary remuneration of 20 000 QP.
- The AGENT of Questra World after achieving the sales volume of 1 000 000 euro, both personally and together with his structure gets monetary remuneration of 50 000 QP.
- The AGENT of Questra World after achieving the sales volume of 3 000 000 euro, both personally and together with his structure gets monetary remuneration of 150 000 QP.
- The AGENT of Questra World after achieving the sales volume of 10 000 000 euro, both personally and together with his structure gets monetary remuneration of 500 000 QP.
- The AGENT of Questra World after achieving the sales volume of 30 000 000 euro, both personally and together with his structure gets monetary remuneration of 700 000 QP.
- The AGENT of Questra World after achieving the sales volume of 100 000 000 euro, both personally and together with his structure gets monetary remuneration of 1 000 000 QP.
- Questra World AGENT who has achieved the 11th level “Super director” starts to receive the additional bonus in the amount of 250 000 QP for each new “Super director” of the 11th level in his structure to the deep of the 5th line.
- The AGENT may express reservations concerning his bonus remuneration within 15 days to the Questra World.
- When introducing new bonus remunerations the AGENT of Questra World will be informed of all innovations, as well as any changes relating to the bonus program.
- The AGENT of Questra World is entitled to get additional monetary bonuses from Questra World under the bonus program - Annex 2. According to the terms of the bonus program the agent must personally or together with his structure make sales volumes necessary for meeting the conditions of the bonus program. Bonus program of Questra World is not attached to the level of the agent and is entirely dependent on the sales volume of the agent and his structure. One of your agents can not be accounted more than 50% of the required volume of sales to get bonuses.
- Crediting Program
- Directors from the 8th level and higher with developing structure have a right on noninterest loan real estate or auto program Questra World.
- To submit an application for getting an interest-free loan, the AGENT of Questra World shall:
- Achieve a level not lower that the 8th – Golden director.
- Receive an additional bonus in the amount of 150 000 QP.
- Set up your own active counseling center and minimum 3 active counseling centers in your structure.
- Have on savings account 25% of cost of real estate or auto chosen by AGENT.
- Work at Questra World as a director 6 months minimum.
- Collect and provide Questra World all the necessary documents.
- An interest-free credit is given to the AGENT only for purchasing a new housing or a new car from an authorized dealer or builder.
- Payment of the loan by the AGENT is provided for 10 years for housing and for 5 years for the car.
- The amount paid by the AGENT for repayment of the loan granted to him shall be deducted from the AGENT once a month from his profit amounting to 50%, with a minimum payout of 250 QP.
- An interest-free loan is paid from the part of the profit received by the AGENT from his structure and the structure itself acts as guarantor of return, as a bail.
- The Period of the Agreement
- This agreement is concluded for an indefinite period.
- The Agreement may be terminated by mutual agreement of the parties on the basis of the prior notification the month before.
- Questra World has the right to terminate the contract at any time and without notice for the following reasons:
- The AGENT breaks local and international laws.
- The AGENT compromise the name Questra World by his actions.
- The AGENT flagrantly violates the terms of the contract.
- The AGENT makes public and nonpublic statements to other agents, causing damage by his actions to the reputation of Questra World.
- Lack of sales by the AGENT and his structures for more than 3 months.
- If it is established that the AGENT works without permission of Questra World for another company carrying on the same activities.
- If the AGENT does not provide accurate and clear information regarding the risk nature of the products of Questra World or makes promises and unrealistic profit forecasts.
- Other Additional Terms
- If a mistake is made when entering the information into the database through the fault of Questra World, the AGENT has the right within 15 calendar days after the establishing of the fact require making corrections. For this purpose, the AGENT submits an application in electronic form to the e-mail of Questra World.
- If the AGENT has professional experience in another company that uses the principle of network marketing for the sale of financial products and services, he may, with the consent of Questra World, occupy that position in his career, which he reached in another company. Before he starts operating as an AGENT of Questra World, he must firstly submit a statement (payslip) containing information about the level and quantity of points, he has reached in another company, then confirm:
- The third level within 3 months from the beginning of the AGENT`s work.
- The fourth level within half a year.
- The fifth level within one a year.
- The sixth level within one year and 6 months.
- The seventh level within two years.
- The eighth level within three years.
- After the expiry of the aforementioned confirmation terms, the position is recalculated according to the actually achieved results.
- The AGENT shall be personally liable to the tax authorities of the country of which he is the citizen, for the payment of taxes on income from his activities as an agent of Questra World.
- The AGENT is obliged to solve all questions relating to the payment of all amounts due from it insurance, pension, medical and other social security contributions in accordance with the laws of his country. Questra World does not have any obligations to pay all of the mandatory contributions.
- In case of the death of the AGENT if his career level is above the 5th, for three years from the date of his death, his legal heirs are paid the part of the profits of the agent`s structure at the following rates: the first year - 75% of the profit, the second year - 50% of the profit, and the third year - 25% of the profit, or by the prior request of the AGENT the achieved position and the structure in the career of Questra World is given to his heirs at law or under a will, certified by the competent authority.
- Upon reaching 6th level the AGENT in a separate agreement specifies the name of the heir to inherit the position reached in the structure in the career of Questra World.
- All Annexes specified in this contract, as well as Annexes for future products of Questra World, are an integral part of this contract. All new changes and additions are published on the website of Questra World 30 days prior to their entry into force.
- Disputes and Legal RelationsThe parties agreed that all disputes arising out of this Agreement shall be resolved through friendly negotiations and consultations between the parties. If no agreement is reached, disputes are referred for settlement to the competent authorities or to the arbitral tribunal in accordance with the current legislation of the United Kingdom.
